This nomination comes as the Trump administration pushes forward an agenda to reshape federal policy on equity, public health, and LGBTQ+ rights. From reinstating transgender military bans to narrowing interpretations of anti-discrimination laws, these actions highlight a broader ideological framework that Kennedy’s confirmation could cement.

Among these is the reinstatement of a transgender military ban and the rollback of diversity, equity, and inclusion (DEI) initiatives across federal agencies. These efforts reflect a deliberate narrowing of protections for marginalized communities:

  • Narrowing Definitions of Sex: A new executive order defines sex as immutable and determined at birth, instructing federal agencies to disregard gender identity in applying anti-discrimination laws. This move could weaken protections in healthcare, housing, and education.
  • Rescission of LGBTQ+ Protections: The administration has rescinded several executive orders from the Biden era, including those implementing the Supreme Court’s decision in Bostock v. Clayton County, which prohibited workplace discrimination based on sexual orientation and gender identity.

The Renewed Transgender Military Ban

Announced via executive order, the policy effectively bars transgender individuals from serving openly in the armed forces, a move that advocacy groups like the Human Rights Campaign and Lambda Legal have vowed to challenge in court.

“Our military service members, including thousands of transgender troops, wear the same uniform, take the same oath, and meet the same rigorous standards,” said Sarah Warbelow, Vice President of Legal at the Human Rights Campaign. “This discriminatory ban insults their service and puts our national security at risk.”

Emily Shilling, a transgender Navy Commander with nearly two decades of service, highlighted the personal impact of the ban. “For nearly two decades, I’ve upheld the highest standards of excellence, leading teams in combat and peace,” Shilling said. “All I ask is the opportunity to keep serving this country with honor, courage, and dedication.”
