Virginia political leaders are sharply divided following theย Supreme Court of Virginiaโs decision to strike down a voter-approved redistricting referendum, with Democrats condemning the ruling and Republicans defending it as a necessary enforcement of constitutional law.
The court ruled 4โ3 that lawmakers failed to follow the constitutional process required to place the amendment on the ballot, invalidating the results of a special election in which more than three million Virginians cast ballots.
Senate Majority Leader Scott Surovell called the decision โwrong on the law and unprecedented in its consequences.โ
โFor the first time in the 250-year history of our Commonwealth, our Supreme Court has set aside the results of a statewide election,โ Surovell said.
Surovell also pointed to the courtโs timing, arguing the justices allowed the vote to proceed before intervening after the fact. โOver three million Virginians participated in this referendum,โ he said. โTheir votes have been set aside not because of fraudโฆ but because four justices have adopted a definition of โelectionโ that conflicts with state statute [and] federal precedent.โ
Earlier in the day, U.S. Senatorย Tim Kaineย raised similar concerns. โThe timing of this ruling speaks volumes,โ Kaine said. โIf the Virginia Supreme Court had legitimate concerns about this referendum, the time to stop it would have been before three million Virginians cast their ballots.โ
The Virginia House Democratic Caucus framed the ruling as part of a broader fight over political power and voter voice. โFrom day one, this was about more than a single election,โ the caucus said in a statement. โIt was about fighting against a political power grabโฆ and making sure the voices of the people matter. The reality that Virginians want to level the playing fieldโฆ is not undone by a court ruling,โ the statement read.
Lieutenant Governorย Ghazala Hashmiย tied the decision to broader national debates over voting rights and redistricting. โThis April, millions of Virginiansโฆ cast their ballots in good faith,โ Hashmi said. โNow, in a 4โ3 decision, the Supreme Court of Virginia has told votersโฆ that their voices can simply be discarded. This decision does not exist in isolation, it comes amid years of assaults on fundamental civil rightsโฆ and coordinated efforts to erode public trust in democratic institutions.โ
Republicans, however, defended the courtโs ruling as a straightforward application of constitutional requirements.
โThe Supreme Court ruling today affirms what we all know: you cannot violate the Constitution to change the Constitution,โ said Ryan T. McDougle.
Democratic Attorney General Jay Jones offered a sharply different assessment, accusing the court of bending the law to reach a political outcome.
โThe Republican-led majority of the Supreme Court of Virginia contorted the plain language of the Constitution and Code of Virginiaโฆ to reach the wrong legal conclusion that fit their political agenda,โ Jones said. โThe consequences of their error are grave.โ
The ruling leaves Virginiaโs current congressional map in place and halts a significant Democratic effort to redraw districts ahead of the next election cycle.
Surovell indicated the fight is not over. โI expect the Commonwealth will pursue every available avenue of further review,โ he said.
